One of the reasons I decided to come back to Hall & Evans recently is that the attorneys here know how to try cases and aren't afraid of the courtroom. I've tried more than fifty cases to juries and it's important to me to work with other attorneys who not only understand courtroom litigation, but actually have the experience doing it. One of the skills you can only develop through actual trial work is picking and advocating to a jury. For the litigators out there, please consider coming to the CBA Litigators' Summit this Thursday where I'll be presenting about the impact of diversity on jury deliberations and how to create diverse juries. Research shows diverse juries have wider ranging deliberations and reach verdicts that are better across almost all metrics. Plus diversity protects against deliberations tainted by bias and ignorance. And because those still impact trials shockingly often, I'll be discussing steps trial lawyers can take to ask for a new trial when verdicts are based on animus and harmful stereotypes, rather than actual evidence. As attorneys on the front lines of often high profile trials, it serves the interests of our clients and our communities to pick juries who will reach fair and unbiased verdicts and increase confidence in the court system.

Having learned last week that around 10,000 documents were not disclosed by legal departments that had a legal professional duty to do so in the Post Office scandal, it seems all the more poignant to have listened to some lesser-known insights that were eloquently shared by Kathleen Donnelly KC, who was part of the claimants’ legal team in civil action against the Post Office, yesterday at the Eagles GC Symposium. The galling fact remains that the legal departments of both Fujitsu and the Post Office, including external legal advisors, have yet to be held to account; nevermind, addressing a clear indication of the endemic and pernicious corporate culture that fostered such an avoidable scandal to occur. Her talk makes clear that scapegoating the few names we now know mainly from Netflix (let’s face it as the case was decided December 2019) hardly scratch the surface of those responsible. Lawyers are held to a higher ethical standard for good reason as gatekeepers of the rule of law and administration of justice. It is clear there is more to be done in making sure in-house counsel and external legal advisors who assist and indeed perpetrate corporate misdeeds and abuse of the legal system are held to account. Where are the lawyers who prosecuted so many of these sub-postmasters based on flimsy or nonexistent evidence and instructed/used intimidation tactics to obtain pleas? Why wasn’t the sudden increase in actions against sub-postmasters noticed as suspect? (Or was it?) Where are the lawyers now that prepared those bundles to instruct counsel in those matters? Have any been challenged or faced consequences? Not only lessons need to be learned here but further professional and legal reprimand is needed for justice in this matter to be properly metered. We need to do better and clearly Lesley Wan and all those involved with pulling off a fabulous senior in-house counsel Eagle event are doing to their part to help achieve that change. California Bar Exam - Board of Trustees (edited snippet) - 16 May 2024 Meeting. I made an error on the date that first pops up on the screen, I put 2021... it was indeed 16 May 2024! Oops. Note, what is being discussed, was the tabled vote on the Kaplan North America creation of Multiple Choice Questions for the Feb 2025 California Bar Exam. The Board of Trustees Meeting from 16 May 2024 is now available online, but the two most important parts of that meeting to me had been my Public Comments, and the last sentence of the meeting. The Board of Trustees is told to be on the lookout for a "poll" for a Special Set meeting (the poll is a tool for them to agree on a time to meet). Here is an edited version of the meeting with my comment, and that last bit of the meeting.:
