A big thank you to ALAI CHILE 2024 and Franz Ruz for inviting me to speak about Free Trade Agreements and collective management from IFRRO's perspective! It was a big pleasure seeing so many old and new friends and esteemed colleagues in Santiago de Chile. For IFRRO, it is important that: - Copyright clauses always include a balanced perspective and a reference to the three-step test enshrined in international copyright treaties (in line with the international obligations of contracting parties), ensuring licensing options, based on a strong protection of copyright; - Provisions on collective management should refer to transparency and good governance of CMOs (in line with IFRRO’s Code of Conduct for RROs); - References to the resale right should be included, as appropriate. Free trade does have a strong impact on CMOs and how rights are administered, as already shown in the July 2000 WTO Dispute Settlement Body Panel Report on the scope of copyright protection under the TRIPs Agreement. The discussions at ALAI were very timely, not least because of yesterday's CJEU decision C-227/23, Kwantum (https://lnkd.in/eGGdXBgG), concluding that material reciprocity of Article 2(7) of the Berne Convention may not be applied to works of applied arts in the EU, underlining the increased importance of multilateral treaties and collaboration. © photos: Kyungsuk Kim, Anita Huss-Ekerhult

The Senegalese Council of Ministers adopts Private Copy Remuneration order. In Senegal, on 16 October 2024, the Council of Ministers adopted the long-awaiting decree to implement the provisions in the Copyright Law on remuneration for private copying of copyright works. Authors, producers and performing artists involved in musical and audiovisual copyright works will now be able to count on equitable remuneration to compensate for the reproduction of their works for private purposes. https://lnkd.in/e9pbg-TK

On 22 October, the RROZ – the Reprographic Rights Organization of Zimbabwe – received the official Certificate of Registration as a Collective Management Organisation (CMO) “in terms of the Copyright and Neighbouring Rights Act” of Zimbabwe. The RROZ Board, chaired by Mr. Masimba Tinashe Madondo, who is also the chairperson at the Zimbabwe Book Publishers Association (ZBPA), comprises both authors, publishers and library representatives. IFRRO has joined CISAC, Collecting Societies for European Visual Artists , GESAC - authorsocieties.eu, Society of Audiovisual Authors, BIEM and AEPO-ARTIS in a joint statement calling on the Finnish Parliament to reverse the recent cut in private copying compensation. Representing European and international associations of authors' and performers' collective management organisations in the audiovisual, music, text and visual arts sectors, we have expressed our grave concern on behalf of both Finnish authors and performers and the entire European/international community of authors and performers whose rights are represented in Finland by our Finnish member organisations. While looking forward to speaking at ALAI CHILE 2024 (https://lnkd.in/eNT_Yw6t) about the "Effects of negotiations and provisions of Trade Agreements on collective management" this week, I took the opportunity to have a working meeting with our Chilean member SADEL and its Board of Directors in Santiago de Chile. With SADEL, we agreed to examine options to clarify the law, ensuring that the voluntary collective licensing provisions are being fully aligned with international treaties and practice, with concrete user reporting obligations, including the surveying of digital uses, in line with SADEL's strategic plan. We also spoke about IFRRO's new mapping project of the landscape of collective management of text and image-based works in Latin America, with Fernando Zapata López as our esteemed consultant, and the envisaged next steps, based on the challenges identified on the basis of questionnaires to authors, publishers, CMOs and IPOs / Copyright Offices in the region.
