Many Americans have turned their backs on democratic politics, preferring instead the technocratic and uncompromising logics of the law. The growing significance of legal maneuvers in the current election is a symptom of that development. Are we entering a „post-political” era?

What can be said about the imminent U.S. presidential election? My scholarly expertise in the law doesn’t equip me to offer special insight into the state of the campaign as it enters its final days. I am not a political scientist, or even a frequent political commentator. I have not studied the function of the states’ vote-counting operations. I have not analyzed the campaigns’ advertising strategies. I do not maintain a sophisticated poll of likely voters in battleground states. Most importantly, my teenage daughter tells me I’m not qualified to discuss the quality or condition of #brat. And, like most Americans, I have no idea what’s going on in Springfield, Ohio!
