Recent reporting by The New York Times, The Wall Street Journal and the Federal Trade Commission (FTC) explores the role of pharmacy benefit managers (PBMs) in determining U.S. spending on prescription drugs. Although PBMs are meant to reduce our spending on prescription drugs by negotiating with pharmaceutical companies and pharmacies, they appear to frequently do the opposite. Instead, these investigations suggest that PBMs are harming competition in the drug supply chain by steering patients toward their own pharmacies and more expensive drugs, and using their market power to charge high markups and hidden fees. Increasingly, patients' first awareness of PBMs comes from encountering problems accessing their medications and facing potentially dire health consequences. Several bipartisan Congressional proposals aim to regulate PBMs. However, it is unclear whether reforms will dampen their ability to deliver as negotiators. In our recent publication in partnership with ATI Advisory, we examine PBM reform proposals and recommend modifications to improve competition and protect consumers from rising prescription costs. Consolidation within the health care system has greatly contributed to the steep rise in health care prices over the years. In West Health’s recent comment letter to the Department of Justice’s Antitrust Division, the Federal Trade Commission and the Department of Health and Human Services, we discuss the clear impacts that hospital consolidation and pharmacy benefit managers' integration with health plans and pharmacies have on the cost of health care services and pharmaceuticals, which is ultimately borne by patients and taxpayers. Of particular concern is the growing number of independent doctor’s offices acquired by hospitals, which results in services in hospital owned doctor’s offices costing more than identical services in independent doctor’s offices. Adoption of site-neutral payment policies where services are paid the same whether supplied by independent doctor or hospital-owned doctor offices would help protect patients, insurers, taxpayers and employers from these price markups—and disincentivize consolidation.
