However, recent research reveals that #state-level private enforcement #statutes are much more complicated than previously thought. The researchers explain why previous theories on private enforcement do not explain the dynamic among the states. They conclude that research on state-level private enforcement demands much more attention than previously provided. Its been just over a year since I transitioned from the Presidency of the European Court of Human Rights into the private sector at the fabulous law firm of Gibson Dunn practicing out of the Paris and London offices. Its been a heck of a ride, challenging and rewarding. I have been asked countless times over the past few months how an international judge can successfully move and adapt from the bench to the bar. Such a transition is very rare in Europe, but has a long history in the US with my partners federal judges Gregg Costa and George Jarrod Hazel as prime recent examples. There is no clear-cut answer. However, what is clear is that the current challenges facing the business sector in the European Union, when it comes to litigation before the EU Courts, dispute resolution and regulatory compliance matters, in particular in the tech and artificial intelligence sectors, are such that insights from the international bench have proven very valuable and effective for our clients. Moreover, the fields of international arbitration and public international law are natural practice areas to transition into after a career on the bench. A highly interesting conference organised by ACE-JA Paris this morning on the introduction and management of cross-border civil and commercial litigation when the defendant is resident in an EU member state outside France. Judicial strategy and the management of international civil and commercial litigation are becoming a reflection of the clash of legal cultures. Careful understanding of the choice : 1️⃣ of the applicable law, 2️⃣ of the competent judge, Depending on whether you are : 3️⃣ in contractual matters, 4️⃣ or in non-contractual matters, 5️⃣ or in specific areas (defective products, unfair competition, intellectual property, environmental damage, employment law), And whether: 6️⃣ this is dealt with in your contract or not 7️⃣ and if the provisio in such contract is valid and applicable or not Is essential for businesses at a time of globalisation of relations and digitalisation of activities and services. This clarity helps them to navigate wisely through the intricacies of cross-border civil and commercial relations in divergent legal systems.
